The conviction

Johnny was convicted in 2008 in Clark County, Nevada. No court has overturned that conviction. He is currently incarcerated in the Nevada prison system and continues to pursue post-conviction review.

His arguments

Johnny argues, among other things, that no valid arrest warrant existed; that jurisdictional and probable-cause errors occurred; that counsel was ineffective; that DNA evidence was mishandled; and that officials engaged in misconduct. Those claims are disputed and are presented here as his positions.

TIMELINE

Investigation and arrest

A police report followed an accusation in 2004. Johnny says investigators seized blood-stained sheets, used a false statement about a pregnancy during a voluntary interview, and later arranged the December 12, 2005 encounter that led to his arrest. His filings argue that no valid arrest warrant existed and that he did not receive the required prompt probable-cause review. These are his allegations, not court findings.

Alleged private recantation

According to the materials in Johnny’s archive, the accuser privately recanted the allegation before his December 2005 arrest. Johnny cites that claimed change in account as part of his later post-conviction narrative. The archive does not establish that a court accepted the alleged recantation as grounds for relief.

Preliminary proceedings

A preliminary hearing was held on March 23, 2006. Johnny contends that the prosecution represented that a warrant existed, portrayed him as having fled, and joined another allegation to strengthen the principal case. He argues that counsel did not challenge those points, seek dismissal, or adequately address bail and arraignment procedures.

Conviction and sentence

On May 8, 2008, in Clark County, Nevada, Johnny was convicted of three counts of sexual assault of a minor under sixteen and one misdemeanor count of open or gross lewdness. The sexual-assault sentences were concurrent life terms with parole eligibility after twenty years; the misdemeanor sentence was concurrent. Johnny maintains his innocence.

State post-conviction proceedings

A state post-conviction hearing addressing counsel performance occurred on December 16, 2011. Johnny’s later filings challenge the handling and sealing of portions of that record and allege that important jurisdictional, forensic, misconduct, and ineffective-assistance issues were not fully presented.

First federal habeas case

Federal case 2:12-cv-00774-MMD-CWH was dismissed without prejudice because grounds remained unexhausted in state court.

Second federal habeas case

In 2:14-cv-00076-APG-CWH, Johnny raised claims involving joinder, sufficiency of the evidence, trial counsel, appellate representation, plea advice, investigation, witnesses, and forensic expertise. On September 29, 2017, the court denied the second-amended § 2254 petition in full, denied a certificate of appealability, and did not hold an evidentiary hearing.

Federal appeal

A notice of appeal was filed on October 10, 2017, under Ninth Circuit docket 17-17031. A certificate of appealability was denied.

Johnny continued filing state petitions and motions addressing subject-matter jurisdiction, the arrest record, conflict-free counsel, DNA evidence, and alleged judicial and prosecutorial misconduct. Current filings

Recent filings include emergency writ requests, motions seeking production of the alleged arrest warrant and other evidence, a request to unseal records, a post-conviction appeal, and a writ of prohibition. Their presence in the archive does not indicate that any request was granted.

Background and arrest

Johnny’s filings describe an investigation beginning in 2004, a voluntary interview, seized evidence, and a December 12, 2005 arrest. He disputes the existence and authenticity of the warrant, the probable-cause review, and the manner in which the charges began.

Alleged recantation

The archive materials state that the accuser privately recanted before the arrest. Johnny relies on that alleged change in account within his post-conviction arguments. This attribution does not mean a court found the recantation credible or granted relief on that basis.

Counsel performance

Johnny alleges that counsel failed to secure computer and phone data, subpoena certain witnesses, retain a DNA expert, and adequately challenge joinder, the flight instruction, and other prosecution conduct.

Broader context allegations

Johnny links his prosecution to earlier FBI attention and to friction surrounding his proposed Flying Saucer Resorts concept. These claims of coordination or outside motive are his allegations and are not presented as established facts.

Federal habeas filings

His first federal petition was dismissed without prejudice for lack of exhaustion. The second addressed joinder, sufficiency, counsel performance, and appellate representation. The petition was denied in 2017, as was a certificate of appealability.

Later post-conviction petitions

Later filings allege that issues involving jurisdiction, exculpatory DNA, prosecutorial conduct, judicial bias, and conflict-free counsel were not adequately raised or resolved. They also challenge representations made to appellate courts.

Current actions and stated objectives

The archive includes habeas requests, writ applications, demands for production of the alleged warrant, efforts to unseal records, and related motions. Johnny states that he seeks to establish that evidence was unlawfully obtained or used and that alleged structural errors render the judgment void. None of those assertions means relief has been granted.
