What Is Exhaustion of State Remedies?
Before a federal court generally may grant habeas relief to a state prisoner, the prisoner must give the state courts a fair opportunity to address the federal claim. This is called exhaustion of state remedies.

Important terms
Fair presentation means presenting the substance of the federal constitutional claim to the state courts in a way that alerts them to its federal nature.
One complete round generally means using the state's established appellate review process, including available discretionary review when required.
A mixed petition contains both exhausted and unexhausted claims.
Why it can matter
Exhaustion protects the state courts' first opportunity to correct alleged violations in state criminal cases.
How a claim was described, which facts supported it, and where it was presented can determine whether the federal version is exhausted.
Limits to keep in mind
Simply presenting similar facts or a state-law claim may not fairly present the corresponding federal constitutional claim.
If state remedies are no longer available, the issue may become procedural default rather than ordinary non-exhaustion. Narrow exceptions and stay procedures may apply in some cases.
